Terms of Service

These Terms are an agreement between you and Beacon Light Investments, LLC ("we", "us"), which makes Fugari Wars (the "Game"), at fugariwars.com and on Steam. By creating an account or playing, you agree to them. If you do not agree, do not play.

The Privacy Policy explains what we collect and why, and is part of these Terms.

1. Who can play

You must be 13 or older. If you live in the European Union or the United Kingdom you must be 16 or older, or have the permission of a parent or guardian, who agrees to these Terms for you. If you are under 18, have a parent or guardian read these Terms with you.

2. Your account

Keep your password and your login (Steam account or phone) to yourself. You are responsible for what happens on your account.
One pilot per person. Extra accounts used to gain an edge (feeding credits, scouting, voting, ganging up) are not allowed.
Your callsign must not impersonate anyone, including us, and must not be offensive.
You may stop playing at any time. To delete your account, email us (see section 13).

3. Early Access

The Game is in Early Access and under active development. Features, balance, rules and content change, sometimes without notice. Cycles reset: the galaxy, your ship, credits, planets and standing are wiped at the end of a cycle, by design. Bugs, outages and fixes can also cause lost progress. We do not promise that the Game will be available at any particular time, or that it will keep any particular feature.

4. How to behave

Do not:

harass, threaten, bully, or stalk anyone, or post hate speech or sexual content, in callsigns, ship names, syndicate chat, gossip, or anywhere else in the Game;
spam, scam, or advertise;
post anyone's personal information;
impersonate us or other players.

In-game deception, betrayal and piracy are part of the Game. Out-of-game harassment is not.

5. Fair play

Do not:

modify, hack or tamper with the client, or use software that does, or that reads or alters the Game's memory or network traffic;
automate play with macros, scripts or bots, except through any automation the Game itself provides;
exploit bugs. Report them to us instead;
attack, overload, or try to gain unauthorised access to our servers or other players' accounts;
reverse-engineer the Game except where the law allows it.

6. Virtual items

Credits, ships, drones, planets, cargo, ranks and everything else in the Game ("Virtual Items") are not your property and have no real-world value. We grant you a limited licence to use them in the Game. We can change, reset, roll back or remove them at any time, including at every cycle reset, to fix bugs, or because of cheating.

Never buy, sell or trade accounts or Virtual Items for real money, on or off our platforms.

7. Purchases

Any paid features are sold through Steam and are covered by Steam's terms and refund policy. Except where the law requires, payments are not refundable by us. Losing access because these Terms were broken does not entitle you to a refund.

8. Player content

Things you write in the Game (callsigns, ship names, chat, gossip, notes) remain yours. You give us a worldwide, royalty-free licence to host, display, and use them to run and promote the Game. Do not post anything you do not have the right to post. We do not monitor all content, but we may remove any of it.

9. AI-generated content

Some in-game text, such as Fugari envoy messages and narration, is generated by an AI model, using your in-game activity (for example your trades and the nodes you visit). It is fiction, can be wrong or strange, and is not a statement by us.

10. Enforcement

If you break these Terms we may warn you, remove content, reset or remove Virtual Items, or suspend or close your account, with or without notice. If you think we got it wrong, email us.

11. Our content

The Game, its software, art, text, music and names belong to us or our licensors. Apart from playing the Game, you may not copy, sell or distribute them. You may stream and post videos and screenshots of the Game.

12. Disclaimers and limits

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT THE LAW ALLOWS. TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA OR PROGRESS, AND OUR TOTAL LIABILITY TO YOU IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE LAST 12 MONTHS OR US$50. Some places do not allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer law.

13. Governing law and contact

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Hillsborough County, Florida, unless the law where you live gives you the right to bring them where you live.

14. Changes

We may change these Terms. If a change is significant, the Game will ask you to accept the new version before you keep playing. If you keep playing after accepting, the new version applies.
